3.2 You may access this Site only to participate in the Site or make Contributions (as defined below) or to place an order for Products. Any other use is prohibited unless agreed to by us in writing. 5. User Review and Contributions
5.1 Users of the Site may submit product reviews, profiles, images, portfolios, videos, instructions, comments, questions, feedback, ideas, suggestions or other information or materials via the Site or otherwise (collectively “Contributions”), so long as such Contributions comply with our contribution standards, set out below in clause 5.2 (“Contribution Standards”).
5.2 Contribution Standards
5.2.1 These standards apply to any and all material which you contribute to this Site, and to any interactive services associated with it including our Stylist Feed. You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.
5.2.2 Contributions must:
5.2.2.1 be accurate (where they state facts);
5.2.2.2 be genuinely held (where they state opinions); and
5.2.2.3 comply with applicable law in Germany.
5.2.3 Contributions must not:
5.2.3.1 contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory;
5.2.3.2 promote sexually explicit material;
5.2.3.3 promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
5.2.3.4 advocate, promote or assist any illegal act, including, but not limited to, violence or computer misuse or the infringement of the intellectual property rights of any other person;
5.2.3.5 be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
5.2.3.6 be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass, alarm or annoy any other person;

5.3 Failure to comply with the Contribution Standards constitutes a material breach of the Terms of Use upon which you are permitted to use this Site. We will determine, in our discretion, whether there has been a breach of the Contribution Standards through your use of this Site. If a breach of the Contribution Standards has occurred, we may take such action as we deem appropriate, including taking all or any of the following actions:
5.3.1 immediate, temporary or permanent withdrawal of your right to use this Site;
5.3.2 immediate, temporary or permanent removal of any posting or material uploaded by you to this Site;
5.3.3 issue of a warning to you;
5.3.4 legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
5.3.5 further legal action against you; and
5.3.6 disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
5.4 Any Contributions shall be and remain our property, and by making a Contribution to the Site you agree to assign to us all worldwide rights, title and interest in all intellectual property in your Contributions. Thus, we will own exclusively all such rights, title and interests in any Contributions, and shall not be limited in any way in its use, commercial or otherwise, of any Contributions. We are and shall be under no obligation to maintain any Contributions in confidence, to pay any compensation or royalty for any Contributions, or to respond to any Contributions.
6. Disclaimer of liability
6.1 Whilst we have taken all reasonable steps to ensure the accuracy and completeness of the information on this Site, it is provided on an “as is” basis and we give no warranty and make no representation regarding the accuracy or completeness of the content of this Site. Further, no warranty is given that the Site shall be available on an uninterrupted basis, and no liability can be accepted in respect of losses or damages arising out of such unavailability. 6.4 Except as expressly provided in these Terms of Use, we exclude all representations, conditions and warranties whether express or implied (by statute or otherwise) to the fullest extent permitted by law.
6.5 We do not seek to exclude or limit our liability to you for:
6.5.1 death or personal injury caused by our negligence;
6.5.2 fraud or fraudulent misrepresentation;
6.5.3 any terms implied under the Product Liability Act (Produkthaftungsgesetz);
7. Miscellaneous
7.1 These Terms of Use are governed by the laws of Germany and only the courts of Germany will have exclusive jurisdiction with respect to any dispute arising under or in relation to them.
7.2 If any provision of these Terms of Use is found to be invalid or unenforceable by a court, it will be severed from the rest of these Terms of Use which shall remain unaffected.
7.3 No delay or failure by us to exercise any powers, rights or remedies under these Terms of Use will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them.

Dies sind die Allgemeinen Geschäftsbedingungen (AGB) der ghd Deutschland GmbH, Leuschnerstraße 43, 70176 Stuttgart (im Folgenden „Anbieter”), die im Rahmen von Kaufverträgen gelten, die über die Plattform www.ghdhair.de zwischen dem Anbieter und den in § 2 des Vertrags bezeichneten Kunden (im Folgenden „Kunde”) geschlossen werden.
1 Geltungsbereich, Begriffsbestimmungen
- Für die Geschäftsbeziehung zwischen dem Anbieter und dem Kunden gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Bestellung gültigen Fassung. Abweichende Bedingungen des Bestellers werden nicht anerkannt, es sei denn, der Anbieter stimmt ihrer Geltung ausdrücklich schriftlich zu.
- Der Kunde ist Verbraucher, soweit der Zweck der georderten Lieferungen und Leistungen nicht seiner gewerblichen oder selbständigen beruflichen Tätigkeit zugerechnet werden kann. Dagegen ist Unternehmer jede natürliche oder juristische Person oder rechtsfähige Personengesellschaft, die beim Abschluss des Vertrags in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
2 Vertragsschluss
- Der Kunde kann aus dem Sortiment des Anbieters Produkte, insbesondere Styler und andere Haarprodukte auswählen und diese über den Button „in den Warenkorb legen” in einem so genannten Warenkorb sammeln. Über den Button „Bestellung abschicken” gibt er einen verbindlichen Antrag zum Kauf der im Warenkorb befindlichen Waren ab. Vor Abschicken der Bestellung kann der Kunde die Daten jederzeit ändern und einsehen. Der Antrag kann jedoch nur abgegeben und übermittelt werden, wenn der Kunde durch Klicken auf den Button „AGB akzeptieren” diese Vertragsbedingungen akzeptiert und dadurch in seinen Antrag aufgenommen hat.
- Der Anbieter schickt daraufhin dem Kunden eine automatische Empfangsbestätigung per E-Mail zu, in welcher die Bestellung des Kunden nochmals aufgeführt wird und die der Kunde über die Funktion „Drucken” ausdrucken kann. Die automatische Empfangsbestätigung dokumentiert lediglich, dass die Bestellung des Kunden beim Anbieter eingegangen ist und stellt keine Annahme des Antrags dar. Der Vertrag kommt erst durch die Abgabe der Annahmeerklärung durch den Anbieter zustande, die mit einer gesonderten E-Mail versandt wird.
3 Lieferung, Warenverfügbarkeit
- Sind zum Zeitpunkt der Bestellung des Kunden keine Exemplare des von ihm ausgewählten Produkts verfügbar, so teilt der Anbieter dem Kunden dies in der Auftragsbestätigung mit. Ist das Produkt dauerhaft nicht lieferbar, sieht der Anbieter von einer Annahmeerklärung ab. Ein Vertrag kommt in diesem Fall nicht zustande.
- Ist das vom Kunden in der Bestellung bezeichnete Produkt nur vorübergehend nicht verfügbar, teilt der Anbieter dem Kunden dies ebenfalls unverzüglich in der Auftragsbestätigung mit. Bei einer Lieferungsverzögerung von mehr als zwei Wochen hat der Kunde das Recht, vom Vertrag zurückzutreten. Im Übrigen ist in diesem Fall auch der Anbieter berechtigt, sich vom Vertrag zu lösen. Hierbei wird er eventuell bereits geleistete Zahlungen des Kunden unverzüglich erstatten.
4 Preise und Versandkosten
- Alle Preise, die auf der Website des Anbieters angegeben sind, verstehen sich einschließlich der Verpackungskosten und der jeweils gültigen gesetzlichen Umsatzsteuer.
- Die Versendung der Ware erfolgt versandkostenfrei.
- Für eine Versendung außerhalb der EU entstehende Import- oder Exportspesen, wie z.B. Zoll, Gebühren und Abgaben gehen stets zu Lasten des Kunden.
- Der Versand der Ware erfolgt per Postversand. Die Lieferadresse wird nur akzeptiert, wenn das Empfängerland mit der von dem Anbieter aufgestellten Internet-Liste übereinstimmt. Gefahr und Zufall gehen im Zeitpunkt der Übergabe der Ware an den Versender (Post, Zustelldienste, Speditionen, Frachtführer usw.) auf den Kunden über.
5 Zahlungsmodalitäten
- Der Kunde kann die Zahlung per Vorauskasse, Kreditkarte, Ratenzahlung oder Nachnahme vornehmen.
- Der Kunde kann die in seinem Nutzerkonto gespeicherte Zahlungsart jederzeit ändern.
- Die Zahlung des Kaufpreises ist unmittelbar mit Vertragsschluss fällig.
- Bei Zahlung mittels Kreditkarte werden nur Zahlungen mittels gültiger Visa- bzw. Mastercard akzeptiert. Bankspesen gehen zu Lasten des Kunden.
6 Eigentumsvorbehalt
- Bis zur vollständigen Bezahlung verbleiben die gelieferten Waren im Eigentum des Anbieters.
7 Sachmängelgewährleistung, Garantie
- Der Anbieter haftet für Sachmängel nach den hierfür geltenden gesetzlichen Vorschriften, insbesondere §§ 434 ff BGB(2 Jahre Gewährleistung). Gegenüber Unternehmern beträgt die Gewährleistungspflicht auf vom Anbieter gelieferte Sachen 12 Monate.
- Eine Garantie besteht bei den vom Anbieter gelieferten Waren nur, wenn diese ausdrücklich in der Auftragsbestätigung zu dem jeweiligen Artikel abgegeben wurde.
8 Haftung
- Ansprüche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon ausgenommen sind Schadensersatzansprüche des Kunden aus der Verletzung des Lebens, des Körpers, der Gesundheit oder aus der Verletzung wesentlicher Vertragspflichten (Kardinalpflichten) sowie die Haftung für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Wesentliche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist.
- Bei der Verletzung wesentlicher Vertragspflichten haftet der Anbieter nur auf den vertragstypischen, vorhersehbaren Schaden, wenn dieser einfach fahrlässig verursacht wurde, es sei denn, es handelt sich um Schadensersatzansprüche des Kunden aus einer Verletzung des Lebens, des Körpers oder der Gesundheit.
- Die Einschränkungen der Abs 1 und 2 gelten auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen des Anbieters, wenn Ansprüche direkt gegen diese geltend gemacht werden.
- Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt.
9 Widerrufsrecht des Verbrauchers
- Widerrufsrecht
Als Verbraucher können Sie Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z. B. Brief, Fax, E-Mail) oder - wenn Ihnen die Sache vor Fristablauf überlassen wird - durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß § 312c Abs. 2 BGB in Verbindung mit § 1 Abs. 1, 2 und 4 BGB-InfoV sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit § 3 BGB-InfoV. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache.

- Widerrufsfolgen
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung - wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre - zurückzuführen ist. Für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung müssen Sie keinen Wertersatz leisten.
Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Verpflichtungen zur Rücksendung der Sachen und Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.
10 Hinweise zur Datenverarbeitung
- Der Anbieter erhebt im Rahmen der Abwicklung von Verträgen Daten des Kunden. Er beachtet dabei die Vorschriften des Bundesdatenschutzgesetz und Teledienstdatenschutzgesetzes. Ohne Einwilligung des Kunden wird der Anbieter Bestands- und Nutzungsdaten des Kunden nur erheben, verarbeiten oder nutzen, soweit dies für die Abwicklung des Vertragsverhältnisses und für die Inanspruchnahme und Abrechnung von Telediensten erforderlich ist.
- Ohne die Einwilligung des Kunden wird der Anbieter Daten des Kunden nicht für Zwecke der Werbung, Markt- oder Meinungsforschung nutzen.
- Der Kunde hat jederzeit die Möglichkeit, die von ihm gespeicherten Daten unter dem Button „Meine Daten” in seinem Profil abzurufen, dieses zu ändern oder zu löschen. Im Übrigen wird in Bezug auf Einwilligungen des Kunden und weitere Informationen zur Datenerhebung, -verarbeitung und -nutzung auf die Datenschutzerklärung verwiesen, die auf der Website des Anbieters jederzeit über den Button „Datenschutz” in druckbarer Form abrufbar ist.
11 Schlussbestimmungen
- Auf Verträge zwischen dem Anbieter und den Kunden findet das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts Anwendung.
- Sofern es sich beim Kunden um einen Kaufmann, eine juristische Person des öffentlichen Rechts oder um ein öffentlich-rechtliches Sondervermögen handelt, ist Gerichtsstand für alle Streitigkeiten aus Vertragsverhältnissen zwischen dem Kunden und dem Anbieter Stuttgart.
- Der Vertrag bleibt auch bei rechtlicher Unwirksamkeit einzelner Punkte in seinen übrigen Teilen verbindlich.

Whom do we share this information with?
